A. HOW TO ENTER THE CONTEST
The KXKL (FM) KOOL105 “Budget Boost” (“Contest”) will begin on Wednesday, January 9, 2013 and will end on January 22, 2013 (the “Contest Period”). This contest will be played Monday – Friday at approximately, 6:13am, 7:13am, 8:13am, 9:13am, 10:13am, 11:13am, 12:13pm, 1:13pm, 2:13pm, 3:13pm and 4:13pm during the Contest Period. A Grand Prize winner will be drawn each weekday at approximately 5:13pm from all of the qualifiers that day. By participating in this contest you understand that a purchase is NOT required for entry nor does it increase chances of winning.
To participate in the Contest, listeners will tune into KXKL 105.1 (FM) (the “Station”) during the Contest Period. When solicited to call – at roughly :13 past the hour, Caller 13 will qualify for $1,000. Qualifiers will be taken at approximately 6:13am, 7:13am, 8:13am, 9:13am, 10:13am, 11:13am, 12:13pm, 1:13pm, 2:13pm, 3:13pm and 4:13pm. A Grand Prize winner will be drawn at approximately 5:13pm from all of that days’ qualifiers. The name will be announced on the air and that person has 5 minutes to call back at (303) 631-1051. If the person does not call back within 5 minutes the jackpot is not given away that day. Listeners can qualify only once per day but can qualify more than once during the contest. The Grand Prize winner will win $1,000.
At the time of their call, the designated caller must provide the Station with their first and last name, complete address, including ZIP Code, phone number and date of birth and social security number. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.
B. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all persons who are 18 years of age or older and who reside in the state of Colorado. Employees of Wilks Broadcasting, the Station, its licensee, and their respective parent, subsidiary, and affiliated entities, their advertising agencies, participating sponsors/promotional partners, other radio stations in the Denver metropolitan area, and the members of their immediate families and/or those living in the same household are ineligible to participate or win.
b. Contestants may only win two prizes per household address every CALENDAR month valued at $100 or under and one big prize valued at over $100 every CALENDAR MONTH. Contestants can only win once per themed contest per Calendar month.
C. PRIZES:
- If the prize is a cash prize, it will be awarded in the form of a Company check and will take up to four (4) weeks to process. If a winner’s cash prize is $600 or greater, they will be contacted to fill out and sign a W-9 before their check request can be submitted. Winner will be called when their check is available for pick up. If a winner wins less than $600 they will not be contacted until their check is ready for pick up.
- All prizes or prize certificates must be picked up at the offices of the Station at the address below. Prize winners will forfeit any prize or prize certificate not claimed within thirty (30) days of being advised that the Prize is available for pick-up. This does not apply to cash prizes. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
d. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash due to prize unavailability or where required by law. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of Station management with respect to the Contest are final.
- Potential Winners will be announced on-air at the time of their calls. Entrants must be listening for the opportunity to call-in to win. Odds of winning depend on the order and number of calls received.
c. All Prize awards are pending verification of eligibility. Winners must execute and return any required affidavit of eligibility and/or liability/publicity release within five (5) days of notification attempt or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Where legal, winners also agree to provide The Station with an interview, which may be used in connection with the Contest.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require verification of winner’s identification by a showing of valid government-issued photo identification. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners to sign a liability release, agreeing to hold Wilks Broadcasting, the Station, its licensee, its parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Contest if he or she tampers with the entry process or the operation of any of the participating stations’ websites or is otherwise in violation of the rules. The Station, in its sole discretion, reserves the right to reject calls from any phone number or phone numbers and to disqualify any person or person who The Station believes is tampering with the entry process in any way, including but not limited to attempts to manipulate the phone system or entry process in order to increase the odds of winning, any other fraudulent activity designed to affect the entry process or who is otherwise in violation of the rules or of any applicable law or regulation. The Station further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of The Station, any segment of the Sweepstakes is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, suspend or cancel the Contest and shall not be required to award a substitute prize.
e. Contestants understand, acknowledge and agree that the Station shall not be liable for losses or injuries of any kind resulting from the rejection of an entry given the Station's belief that the contestant was abusing or tampering with the Contest entry process in any manner or due to any technical malfunction of the telephone network/transmission line or any entries that are late, delayed, garbled, incomplete, misdirected, lost, corrupted or otherwise not in compliance with the rules or applicable law.
f. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, or other technological failures, telephone service outages, delays, dropped calls, or busy signals; (iii) lost, stolen, mangled, misdelivered, postage due, illegible, incomplete, incorrect, or late entries.
g. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
